Terms of Service

1. Agreement

By visiting the service, submitting a listing, checking the acceptance box, or paying, you agree to these Terms, the Advertising Rules, and the Privacy Policy. If you do not agree, do not submit or pay.

The service is operated under the Brand My Goldfish project name (“My Goldfish,” “we,” “us,” or “our”). Legal and rights notices may be sent to legal@brandmygoldfish.lol.

2. Eligibility and authority

You must be at least 18 years old and legally able to enter a binding contract. If you act for a company or another person, you represent that you have authority to bind them. You may not use the service where doing so is prohibited by law, sanctions, payment-network rules, or contractual restrictions.

3. The service

My Goldfish sells one-time digital advertising placement in one of 10 fixed aquarium billboards. Empty billboards start at $5. An occupied billboard may be replaced only by paying exactly $1 more than its current confirmed purchase price.

Once Dodo Payments confirms payment, the new creative replaces the previous creative in that billboard. A purchase does not guarantee how long the billboard remains yours, impressions, traffic, clicks, leads, sales, search ranking, uptime, or any other result. Another advertiser may replace you immediately.

4. Advertising—not an investment

Your payment buys advertising only. It is not a deposit, investment, security, token, wager, managed account, partnership, loan, ownership interest, or promise of financial return. You receive no rights in sponsor revenue, my goldfish, any trading account, assets, content revenue, gains, or losses.

The fish-signal concept is entertainment. It is not investment, tax, legal, or financial advice and must not be relied on for trading. Signals or trades may be simulated, delayed, paused, modified, or discontinued. Any real-world allocation of net sponsor revenue remains subject to fees, taxes, reserves, operating costs, law, platform availability, risk controls, and animal welfare.

5. Your submission and warranties

You are responsible for your brand name, tagline, destination, logo, claims, and all material available through the destination. You represent and warrant that:

• You own or are authorized to use and advertise every submitted element.
• Your submission and destination are accurate, lawful, safe, and do not violate another person’s rights.
• You hold every license, approval, and disclosure required for the advertised business, claim, product, or jurisdiction.
• You will not hide the destination, introduce malware, manipulate clicks, or materially change a reviewed destination into prohibited content.
• Your submitted contact email is accurate and monitored.

6. License you grant us

You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, resize, crop, format, publicly display, and link your submitted brand, tagline, logo, destination metadata, and related creative as needed to operate, moderate, archive, and promote the service. This license lasts while reasonably needed to provide the service, maintain records, resolve disputes, and show historical or promotional material, subject to applicable law.

7. Moderation and enforcement

We may investigate, refuse, delay, edit for formatting, recategorize, hide, suspend, or remove any listing or account—with or without notice—if we reasonably believe it violates these Terms or the Rules, infringes rights, presents fraud or security risk, threatens animal welfare, creates legal or reputational risk, or is required by a payment provider or authority. We may preserve evidence and cooperate with lawful requests.

8. Payments, taxes, and final-sale policy

Checkout is processed by Dodo Payments as Merchant of Record. We do not receive full card numbers. Prices are shown in US dollars; applicable taxes or provider charges may be added. Placement begins after signed payment confirmation.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE TO THE FULLEST EXTENT PERMITTED BY LAW. My Goldfish does not offer discretionary refunds, credits, or exchanges. By checking the acceptance box and paying, you expressly request and consent to immediate performance of the digital advertising service and, to the extent legally permitted, waive any cancellation, cooling-off, or withdrawal right once performance begins.

Being replaced by a buyer who pays the displayed current price plus $1; receiving fewer impressions, clicks, leads, or sales than expected; disliking placement, size, appearance, or results; temporary downtime; layout, slot, feature, or policy changes; service discontinuation; or rejection, suspension, or removal for breach does not create a right to a refund or credit.

The only exceptions are refunds required by applicable law or independently required or approved by Dodo Payments under its buyer terms and Merchant-of-Record obligations. Dodo Payments retains final authority over refunds, duplicate charges, technical billing errors, tax adjustments, disputes, and chargebacks. Nothing in these Terms limits a mandatory right that cannot lawfully be waived. Fraudulent or baseless chargebacks may result in immediate removal and future refusal of service.

9. Intellectual-property and rights notices

My Goldfish branding, original visuals, software, and content belong to us or our licensors. Third-party brands belong to their owners and their appearance does not imply endorsement.

For a copyright, trademark, privacy, publicity, defamation, or unlawful-content complaint, email legal@brandmygoldfish.lol with your identity and contact details, the affected billboard and URL, the right involved, supporting evidence, and a good-faith statement that the notice is accurate and authorized. We may temporarily restrict material while reviewing a notice and may share the notice with the advertiser.

10. Third parties and outbound links

Advertiser destinations and third-party services—including Dodo Payments, hosting, database, and trading or market-data providers—operate under their own terms and practices. We do not control or endorse them and are not responsible for their content, availability, security, acts, or omissions.

11. Availability and disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant uninterrupted or error-free operation, accurate click counts or ranks, secure external destinations, or any commercial or financial result.

12. Limitation of liability

Nothing excludes liability that cannot lawfully be excluded. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, exemplary, or consequential loss; lost profit, revenue, opportunity, goodwill, or data; trading or market loss; third-party conduct; or advertiser content.

To the fullest extent permitted by law, our aggregate liability arising from the service or a placement will not exceed the amount you paid for the placement giving rise to the claim during the three months before the event. These limits apply regardless of legal theory and even if a remedy fails of its essential purpose.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless My Goldfish and its operators, contractors, and service providers from claims, losses, liabilities, penalties, and reasonable legal costs arising from your submission, destination, business, breach, chargeback, unlawful conduct, or infringement of another person’s rights. We may control the defense and you will reasonably cooperate.

14. Suspension, termination, and changes

We may suspend or discontinue the service or your access. Terms may change as the service, providers, or law changes. The updated date identifies the current version. Material changes apply prospectively unless immediate changes are required for law, fraud, security, or safety. Continued use after an update means acceptance of the updated Terms.

15. General

Applicable mandatory law controls governing law and venue. Where parties may choose, disputes will be governed by the law and courts of the place where the service operator is legally established, without applying conflict-of-law rules. Before filing a claim, contact us and allow 30 days for an informal resolution attempt unless urgent relief is required.

If a provision is unenforceable, the rest remains effective. A failure to enforce is not a waiver. You may not assign these Terms without consent; we may assign them with the project or business. These Terms, the Rules, Privacy Policy, and checkout details form the entire agreement for the service.
